The Investigating Directorate against Corruption's deputy director of Public Prosecutions, Peter Serunya appeared before the Madlanga commission on Tuesday.
He told commissioners he never received the Section 27 referral that initiated the investigation into Crime Intelligence head Dumisani Khumalo and his co-accused.
Serunye told commissioner Sesi Baloyi that he repeatedly requested the document, stating the missing referral became an issue when the accused requested further particulars during court proceedings.
“I spoke with Mr Brian Padayachee. I said the accused had asked for further particulars, and one of the issues they are raising is that they want to be provided with the Section 27 referral. From August, I was looking for that document, but no one could give it to me.”
Padayachee is the investigating officer in the criminal case involving Crime Intelligence head Lieutenant General Dumisani Khumalo and three other senior officers, who were arrested in June last year.
The officers face fraud and corruption charges for allegedly colluding to appoint an inexperienced person, Dineo Mokwele, to a senior position within Crime Intelligence.

Padayachee was called to the commission to respond to allegations relating to the alleged capture, corruption and criminalisation of parts of the criminal justice system, including claims that IDAC has operated outside its legal mandate, interfered in investigations and prosecutions, and pursued criminal cases for political reasons.
The investigator has since been placed on suspension pending disciplinary proceedings.
Serunye also disputed claims made at the commission that the unit's Operations Manual is not in use.
Former IDAC head Andrea Johnson gave the impression that the Operations Manual was not really applied in practice.
Responding to evidence leader Thabang Pooe's question, the deputy director said that the manual guides IDAC's daily procedures, operational standards and processes since 2024.
