The Constitutional Court has rejected Parliament’s bid to appeal a Western Cape High Court ruling halting President Cyril Ramaphosa’s Phala Phala impeachment process pending a judicial review.

The Constitutional Court has denied a direct application for leave to appeal against the judgment of the Western Cape High Court halting the impeachment process against President Cyril Ramaphosa.

Parliament’s Section 89 Committee wanted to appeal the Western Cape High Court ruling, which effectively paused the impeachment proceedings related to the Phala Phala scandal.

The EFF, ATM and MK parties also joined the application.

They approached the apex court after the president won a High Court bid to stop the impeachment process while he challenges the findings of the Section 89 Independent Panel report.

The High Court ruling interdicted the Impeachment Committee from continuing with public hearings pending a full judicial review application to set aside the Phala Phala independent panel report, which is scheduled to be heard in the first week of September.

“We will therefore move forward in line with the Western Cape High Court judgment,” the chairperson of the committee, Makashule Gana, said following the Constitutional Court ruling.

“We are going to finalise the committee’s terms of reference and also receive an update on the appointment of the evidence leader at our next meeting.”

The committee has completed the recommendation regarding the evidence leader and is finalising its terms of reference, which will guide its work.

“Once the evidence leader has been appointed, we will move to the next stage, which will include considering the list of witnesses,” Gana added.
